1. Who We Are and What This Agreement Covers
This website, easydone.co.za ("the Site"), is operated by EasyDone ("EasyDone", "we", "us", "our"), a business based in Johannesburg, South Africa, selling products directly to consumers through the Site. Anyone who browses, registers on, or buys from the Site ("you", "the Customer", "the User") accepts these Terms and Conditions in full by doing so.
Please read this Agreement carefully. If you do not agree to it, please do not use the Site. We may update these Terms from time to time in accordance with Section 24; continued use of the Site after an update constitutes your acceptance of the revised Terms.
2. Definitions
- "Consumer" means a natural person purchasing goods primarily for personal, household or family use, as defined in the CPA.
- "Goods" means the physical products offered for sale on the Site.
- "Services" means the online retail functionality of the Site.
- "Order" means a request to purchase Goods placed through the Site's checkout process.
- "Business Day" means Monday to Friday, excluding South African public holidays.
- "Personal Information" has the meaning given to it in POPIA.
3. Eligibility and Site Access
You must be 18 years or older, or have the consent of a parent or legal guardian, to place an Order on the Site. By using the Site you confirm that you have the legal capacity to enter into a binding contract under South African law.
We may suspend, restrict or terminate your access to the Site at our reasonable discretion where we believe, on reasonable grounds, that these Terms have been breached, that fraudulent or unlawful activity is taking place, or that continued access poses a security risk to EasyDone or other users. Wherever practical, we will give you notice and an opportunity to respond before doing so.
4. General Conditions of Use
You may not use the Site for any unlawful purpose, or in any way that infringes the rights of EasyDone or any third party, including intellectual property, privacy, or consumer protection rights.
You may not introduce viruses, malware, or any code intended to disrupt, damage, or gain unauthorised access to the Site or its underlying systems.
Content submitted through the Site (excluding payment card details) may be transmitted over open networks and may be adapted to meet technical requirements of the networks or devices it passes through. Payment information is always transmitted using encrypted, PCI-DSS-compliant channels through our payment gateway partner.
You may not reproduce, resell, or commercially exploit any part of the Site, its content, or access to it, without our prior written consent.
5. Product Information, Pricing and Availability
We take reasonable care to ensure that product descriptions, images, and pricing on the Site are accurate at the time of publication. However, occasional errors in description, pricing, or stock availability may occur. Where a genuine pricing or listing error is identified before an Order is dispatched, we will contact you to offer the correct price, a substitute, or a full refund, in line with our obligations under the CPA — we will not simply cancel your order and keep your money.
All prices are quoted in South African Rand (ZAR) and are inclusive of Value-Added Tax (VAT) at the applicable statutory rate, unless stated otherwise. Delivery charges are shown separately at checkout before payment is confirmed.
Product colours may appear slightly different on different screens; this is a display limitation and not a defect.
We reserve the right to discontinue any product, and to limit order quantities to prevent bulk reselling by dealers or resellers, provided this is applied consistently and not used to unfairly discriminate against individual consumers.
6. Placing an Order
An Order placed through the Site is an offer by you to purchase the Goods. No contract exists between you and EasyDone until we have accepted your Order by sending you a confirmation email or dispatch notice. Until that point, we may decline to fulfil an Order — for example where stock has run out, where a pricing error has occurred, or where fraud is suspected — and any payment already made will be refunded in full within a reasonable time.
You are responsible for ensuring that your billing, delivery and contact details are accurate and current. EasyDone is not liable for delayed or failed delivery caused by incorrect information supplied by you, although we will make reasonable efforts to assist in resolving the issue.
7. Payment
We accept payment via the secure, PCI-DSS-compliant gateways displayed at checkout. We do not store your full card details on our own servers.
Full payment is required before an Order is dispatched, unless a different arrangement has been agreed with you in writing.
In the event of a failed or disputed payment, we may suspend or cancel the related Order until the matter is resolved.
8. Delivery
We aim to dispatch and deliver Goods within the timeframes stated on the Site or in your Order confirmation. These timeframes are estimates and not guaranteed delivery dates, as they depend in part on our courier partners. Where a delay becomes likely, we will notify you and offer the option to cancel for a full refund if the new timeframe is unacceptable to you.
Risk in the Goods passes to you on delivery to the address you provided. Ownership passes once payment has been received in full.
Regional and outlying-area surcharges, where applicable, will be disclosed to you before you complete your Order, not added afterwards.
9. Your Right to Cancel (Cooling-Off Period)
Under Section 44 of ECTA, because this is an electronic transaction, you have the right to cancel your Order, without reason and without penalty, within 7 (seven) days of receiving the Goods, by giving written notice to info@easydone.co.za. You remain responsible for the direct cost of returning the Goods, and the Goods must be returned substantially in the condition they were delivered.
This cooling-off right does not apply to: goods made to your specification or clearly personalised; sealed goods that were unsealed after delivery and cannot be returned for hygiene reasons; and goods that by their nature deteriorate or expire rapidly. These exclusions will be clearly flagged on the relevant product page.
This right is separate from, and additional to, your rights under Section 10 below.
10. Returns, Refunds and Product Quality
Under Section 56 of the CPA, you have the right to return Goods that are unsafe, of poor quality, or defective within 6 (six) months of delivery, for a full refund, replacement, or repair, at your election, provided the Goods have not been misused.
Outside of that statutory right, and subject to the specific Returns Policy published on the Site (which forms part of this Agreement by reference), we accept change-of-mind returns within a stated window, provided items are unused, in original packaging, and accompanied by proof of purchase. A reasonable handling or restocking fee may apply to change-of-mind returns — this will always be disclosed to you before the return is finalised, and will never be applied to a return arising from a faulty or misdescribed product.
Refunds are processed to the original payment method within a reasonable time of the returned Goods being received and inspected.
11. Intellectual Property
All content on the Site — including but not limited to the EasyDone name, logo, design, layout, graphics, and original product copy — is owned by or licensed to EasyDone and is protected by South African copyright and trademark law.
You may not copy, reproduce, or commercially reuse any part of the Site's content without our prior written permission.
12. Third-Party Tools and Links
The Site may link to, or rely on, third-party platforms and tools (including payment gateways and courier services) that we do not own or control. We are not responsible for the content, security, or performance of these third parties, though we will act reasonably in choosing reputable partners and in assisting you to resolve issues that arise through them.
13. User Content and Feedback
If you submit reviews, comments, or suggestions to us, you grant EasyDone a non-exclusive, royalty-free licence to use, reproduce and display that content in connection with our business, for example on the Site or in marketing. You remain responsible for ensuring your submissions are lawful, accurate, and do not infringe anyone else's rights. We may remove content we reasonably believe to be false, defamatory, or in breach of these Terms.
14. Protection of Personal Information (POPIA)
EasyDone processes your Personal Information in accordance with POPIA and our Privacy Policy, published on the Site and incorporated into this Agreement by reference. In summary:
- We collect only the Personal Information reasonably necessary to process your Order, manage your account, provide our Services, and comply with legal obligations (e.g. tax and accounting records).
- We do not sell your Personal Information to third parties. It is shared only with service providers who need it to fulfil your Order (e.g. couriers, payment processors) or as required by law.
- You have the right to request access to, correction of, or deletion of your Personal Information, and to object to certain processing, subject to our own legal retention obligations.
- We maintain reasonable technical and organisational security measures to protect your information, and will notify you and the Information Regulator of any data breach as required by POPIA.
Our full Privacy Policy sets out further detail, including how to lodge a complaint with our Information Officer or with the Information Regulator of South Africa.
15. Prohibited Conduct
You may not use the Site to: act unlawfully; infringe intellectual property or privacy rights; harass, defame, or discriminate against any person; submit false information; transmit malicious code; scrape or harvest data; or attempt to circumvent the Site's security. We may suspend or terminate access for any breach of this Section, and, where warranted, report unlawful conduct to the relevant authorities.
16. Disclaimers and Limitation of Liability
Nothing in this Section limits any right or protection that cannot lawfully be excluded under the CPA, ECTA, or any other South African legislation, including your rights relating to defective, unsafe, or misdescribed Goods.
Subject to that, and to the fullest extent otherwise permitted by law, EasyDone provides the Site on an "as is" and "as available" basis and does not guarantee that the Site will be uninterrupted or error-free. EasyDone's total liability arising from your use of the Site is limited to the value of the relevant Order, except where loss arises from EasyDone's gross negligence, wilful misconduct, or fraud, in which case this limitation will not apply.
EasyDone is not liable for indirect or consequential loss (such as loss of profit or business opportunity), except where such exclusion would be unlawful.
17. Indemnity
You agree to indemnify EasyDone, its directors, employees and agents against any reasonable loss, claim, or expense (including legal costs) arising from your breach of this Agreement or your unlawful use of the Site, save to the extent that such loss, claim, or expense was caused by EasyDone's own negligence or breach of this Agreement.
18. Force Majeure
Neither party will be liable for delay or failure to perform an obligation under this Agreement where this is caused by circumstances reasonably beyond that party's control, such as natural disaster, load-shedding, courier network failure, or a change in law. The affected party will notify the other as soon as reasonably possible and take reasonable steps to minimise the impact.
19. Severability
If any provision of this Agreement is found to be unlawful or unenforceable, that provision will be treated as removed to the extent necessary, and the remainder of the Agreement will continue in full force.
20. Suspension and Termination
This Agreement remains in effect for as long as you use the Site. We may suspend or terminate your access for a material breach of these Terms, following reasonable notice where practical. Obligations that by their nature should survive termination — including payment obligations, confidentiality, and limitation of liability — will continue to apply after termination.
21. Complaints and Dispute Resolution
If you have a complaint, please contact us first at info@easydone.co.za so we can try to resolve it directly. If we are unable to resolve a consumer complaint to your satisfaction, you may refer it to the Consumer Goods and Services Ombud (www.cgso.org.za) or the National Consumer Commission, in accordance with your rights under the CPA. Nothing in this Section limits your right to approach a South African court at any time.
22. Governing Law and Jurisdiction
This Agreement is governed by the laws of the Republic of South Africa. Both parties consent to the non-exclusive jurisdiction of the South African courts.
23. Entire Agreement
This Agreement, together with our Privacy Policy and Returns Policy, constitutes the entire agreement between you and EasyDone regarding your use of the Site, and supersedes any prior discussions or agreements on the same subject. Our failure to enforce any provision of this Agreement at any time does not waive our right to enforce it later.
24. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business or the law. The current version will always be available on the Site, with the "last updated" date shown at the top. Material changes affecting your existing rights will be communicated to you directly where reasonably possible.
